PROBATE

This form will allow you to calculate the fee that the attorney AND the executor would be entitled to collect for conducting the probate(court proceeding) of your estate. Having a will does not avoid probate. The method of calculation is set by California law. By inputting your information, you can compare the fees to the cost of setting up a living trust, which typically ranges from $4,000 to $4,500.

ESTATE TAX

Regardless of whether your assets pass by probate, by trust, or directly to beneficiaries, the IRS requires that a tax return be filed within 9 months of death, and tax paid on any amounts in excess of $12,060,000 less amounts left to a spouse or a charity. Your taxable estate includes all assets you have control over. This form will calculate the amount of the tax liability on your estate.
